What the law requires of landlords

If you let a property with gas appliances, the Gas Safety (Installation and Use) Regulations 1998 require every gas appliance and flue you provide to be checked for safety every 12 months by a Gas Safe registered engineer. You must give existing tenants a copy of the record within 28 days of the check and give new tenants a copy before they move in. Keep your own copy until two further checks have been carried out, which in practice means at least two years. The check can be carried out up to two months before the current record runs out without losing the original renewal date. HSE’s gas safety record guidance sets out the rules in full.

What the engineer checks during a gas safety inspection

The engineer checks each gas appliance you provide, such as the boiler, gas fire and gas cooker, together with the flues and visible pipework. That includes checking that the appliances are burning correctly, the flues are carrying fumes away safely, there is enough ventilation and the safety devices work. The record lists every appliance checked, the result, any defect found and the action taken or advised.

If an appliance fails the check

If the engineer finds a fault, they explain what is wrong and what it means for safety. The record is still issued, with the defect written on it, and an appliance that is unsafe must not be used until it is repaired. Repairs are quoted separately and the price is agreed with you before any work starts.

Gas safety check and boiler service together

A gas safety check records whether the appliances are safe. A boiler service maintains the boiler as the manufacturer requires. One does not replace the other. Booked together in one visit they cost £168, a saving of £62 on booking them separately.

Carbon monoxide alarms

Since 1 October 2022, landlords in England must fit a carbon monoxide alarm in any room used as living accommodation that contains a fixed combustion appliance, such as a gas boiler or gas fire. Gas cookers are the exception. If a tenant reports that an alarm is faulty, it must be repaired or replaced.

Appliances your tenant owns

You are not responsible for safety checks on gas appliances your tenant owns, or on flues that serve only those appliances. You remain responsible for the gas pipework in the property.

If a tenant will not allow access

Keep a written record of every attempt to arrange the check. HSE’s guidance is that a landlord must be able to show they took all reasonable steps, for example by writing to the tenant to explain that the check is a legal requirement for their own safety and by offering other appointments. You must not force entry.

HMOs and licensed properties

If the property is a licensed house in multiple occupation, a condition of the licence is that you send the council a gas safety certificate every year. In West Yorkshire that is Bradford Council, Leeds City Council, Calderdale Council, Kirklees Council or Wakefield Council, depending on where the property is. Some councils also run licensing schemes for other rented homes, so check what yours asks for.

Questions customers ask

How much is a landlord gas safety certificate?

£115 for the gas safety check and record, or £168 for a gas safety check and a boiler service in the same visit.

How often does a landlord need a gas safety certificate?

Every 12 months. The check can be done up to two months before the current record expires without changing the renewal date.

Is a CP12 the same as a gas safety certificate?

Yes. CP12 was the form number used when CORGI ran the gas register. The name has stuck, and both names mean the landlord gas safety record.

What happens if a landlord has no gas safety certificate?

Failing to arrange the annual check is a criminal offence under the Gas Safety (Installation and Use) Regulations 1998 and can lead to prosecution by the Health and Safety Executive.

How long does a gas safety check take?

It depends on how many gas appliances there are. Tell us the appliances when you book and we will give you a time window.

Do homeowners need a gas safety certificate?

There is no legal requirement for owner-occupiers, but many homeowners book a gas safety check for peace of mind or when buying a property.
